Terms of Service

By using CloudTM, you agree to these terms. Please read them carefully.
CloudTM is a service provided by Bouwhuis IT. In these terms, "CloudTM", "we", "our", and "us" refer to Bouwhuis IT. Full registration details are listed at the bottom of this page.
The Service
CloudTM provides cloud-based backup storage for macOS computers using Apple's Time Machine. We provide the infrastructure; Apple's software handles the actual backup process.
Your Account
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account
- You must be at least 18 years old to use this service
- One account per person or organization
Acceptable Use
You agree not to:
- Use the service for illegal purposes
- Store illegal content
- Attempt to access other users' data
- Resell or redistribute the service
- Interfere with or disrupt the service
- Exceed your storage quota
Payment & Billing
- Subscriptions are billed monthly or annually in advance
- Prices are in Euros and include VAT where applicable
- You can cancel at any time; service continues until the end of your billing period
- We may change prices with 30 days notice
- Refunds are provided at our discretion
Service Availability
We aim for high availability but cannot guarantee 100% uptime. We are not liable for:
- Scheduled maintenance (we'll notify you in advance)
- Outages beyond our control (internet issues, force majeure)
- Issues caused by Time Machine or macOS
Data & Backups
- You retain ownership of all data you back up
- We do not access your backup contents (they are encrypted)
- You are responsible for maintaining local copies of critical data
- We are not a replacement for a comprehensive backup strategy
Termination
We may terminate or suspend your account if you:
- Violate these terms
- Fail to pay for the service
- Use the service in a way that harms us or other users
Upon termination, you have 30 days to download your data before it is deleted.
Limitation of Liability
To the maximum extent permitted by law, CloudTM is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
Changes to Terms
We may update these terms. We'll notify you of significant changes via email. Continued use after changes constitutes acceptance.
Governing Law
These terms are governed by Dutch law. Disputes will be resolved in Dutch courts.
